Summary (as Amended 5/09/2011): Creates an additional fine of up to $25,000 ($92,603 with penalty assessments) for any person convicted of procurement of a minor, under the age of 18, for the purposes of engaging in prostitution. Specifies that the fine shall be available to fund programs and services for commercially sexually exploited minors in the counties where the offenses are committed.

Summary (as Amended 3/31/2011): This bill would establish the School Medication Authorization Task Force, consisting of 10 members who would be appointed by, and serve by the pleasure of, the Superintendent of Public Instruction. The bill would require the task force to provide specified advice regarding the administration of emergency medication to a pupil on a school campus and establish training and supervision standards regarding the administration of medical care in a school setting. The bill would require the task force to follow prescribed procedures relating to its operation.

Summary (as Amended 6/30/2011): Requires a physician and surgeon's certificate to be automatically placed on inactive status during any period of time that the certificate holder is incarcerated after conviction of a misdemeanor, and requires the reason for this inactive status to be disclosed on the Internet website of the Medical Board of California (MBC). Also requires a certificate placed on inactive status pursuant to this bill to be returned by the MBC to its prior or appropriate status within five business days of receiving notice, as specified by the MBC via regulations, that the physician and surgeon is no longer incarcerated.

AB 760: Assemblymember Richard Gordon (D-Menlo Park)
Healthy Start Community Schools Act
Summary (as Amended 4/4/2011): This bill renames the Healthy Start Support Services for Children Act the Healthy Start Community Schools Act (HS program), and makes the following changes to the program.
- Increases the number of grants awarded to local education agencies (LEAs) or consortia from two to three.
- Requires operational grant funds to be limited to coordination activities either at the site or at the community or district level.
- Authorizes supplemental funds to be awarded for direct service to an LEA or consortium to address a specific and serious service gap. This bill further requires this request to include a plan for evaluating the impact of the service and for paying for the service once the grant has ended.
- Repeals the provision that specifies no more than 50% of operational grants to be available for expenditure on direct services, as specified.
- Modifies the grant application by requiring applicants to include a specific explanation of how any Medi-Cal administrative activities may be reinvested into the program.
- Requires the evaluation of HS program to include information regarding improvements in average daily attendance as well as individual attendance for pupils who have directly benefited from program services.

Tribal gaming: local agencies
Summary (as Amended 8/16/2011): This bill, would prohibit a lead agency with jurisdiction over a proposed aggregate mining operation from approving a reclamation plan of a mining operation from approving a reclamation plan of a mining operation that is proposed to be constructed within specified distances of a Native American sacred site or an aquifier that is hydrologically connected to the Santa Margarita River without the consent of the tribe whose reservation is nearest the proposed operation.
The purpose of this bill is to prohibit a single mining operation that is proposed in Riverside County at a location that the Pechanga Tribe of the Luiseno Peoples considers its most important sacred place, the place considered to be the Place of Creation.

Summary (as Amended 8/9/2012): This bill would prohibit a health care service plan contract and a health insurance policy issued, amended, or renewed on or after July 1, 2013, that provides coverage for cancer chemotherapy treatment from requiring a higher copayment, deductible, or coinsurance amount for a prescribed, orally administered anticancer medication than the health care service plan or health insurer requires for an intravenously administered or injected cancer medication, as specified. The bill would prohibit a health care service plan or health insurer from being deemed to have complied with these provisions by increasing the copayment, deductible, or coinsurance amount for an intravenously administered or injected cancer chemotherapy agent. The bill would specify that its provisions do not apply to a health care service plan contract or health insurance policy that does not provide outpatient prescription drug coverage or to a health care benefit plan, contract, or policy with the Board of Administration of the Public Employees' Retirement System. The bill would also provide that no benefits are required to be provided under its provisions that exceed the essential health benefits that will be required under specified federal law.

Immunizations for children: reimbursement for physicians
Summary (as Amended 4/30/2012): This bill requires health plans and insurers to reimburse physicians and physician groups for certain costs related to the administration of vaccines.
1) Requires health plans and insurers that cover child and adolescent vaccines to reimburse physicians/physician groups in an amount not less than the actual cost of acquiring the vaccine plus the cost of administering the vaccine.
2) Defines the vaccine acquisition cost as those standardized costs detailed on the most current Pediatric Vaccine Price List published by the Centers for Disease Control and Prevention, plus shipping and handling costs.
3) Defines the vaccine administration cost as not less than the cost specified in the most current Medicare physician fee schedule.
4) With respect to vaccines that are not part of a contract between a physician/physician group and a health plan or insurer, strikes existing reimbursement requirements and applies the reimbursement provisions in (1-3) above.
5) Allows physicians and physician groups to assume financial risk for providing required immunizations, but prohibits a health plan or policy from requiring a physician or a physician group to accept financial risk or impose additional risk that would violate the reimbursement provisions in (1-3) above.
6) Exempts CalPERS plans from reimbursement provisions in (1-3) above.

SB 703: Senator Ed Hernandez (D-West Covina)
Health Care Coverage: Basic Health Program
Summary (as Amended 6/25/2012): This bill would establish in state government a Basic Health Program to be administered by the department. The bill would require the department to enter into a contract with the US Secretary of Health and Human Services to implement the Basic Health Program, and would set forth the powers and the duties of the department relative to determining eligibility for enrollment, setting premiums for coverage, and selecting participating health plans under the Basic Health Program, subject to requirements under federal law. The bill would require the department to permit enrollment in the Basic Health Program on January 1, 2014. The bill would create the Basic Health Program Trust Fund for those purposes and would make moneys in the fund subject to appropriation by the Legislature, except that if the annual Budget Act is not enacted by a certain date, the bill would authorize the department to transfer specified funds from the trust fund to health plans in order to comply with certain requirements, thereby making an appropriation. The bill would require the Basic Health Program to be funded by federal funds, private donations, premiums paid by eligible individuals, and other non-General Fund moneys available for that purpose. Nonwithstanding those provisions, the bill would authorize the department to obtain loans from the General Fund for initial start up expenses, to be repaid July 1, 2016, and would establish a procedure for continued coverage of individuals under the California Health Benefit Exchange if costs of the Basic Health Program exceed moneys available from specified sources. The bill would require the department to request an evaluation of the Basic Health Program and to seek funding for the evaluation from an unspecified independent nonprofit private foundation.

Summary (as Introduced 2/18/2011): This bill would specify that a mediator and a licensed mental health professional are not liable for damages for an act or omission constituting ordinary negligence that occurs on or after January 1, 2012 during the performance of the above-described mediation and counseling services. The bill would also prohibit a person from making a complaint to the board that issued a license to practice to the provision of those services and would, instead, require that the complaint be made to the court that set the matter for mediation or that required outpatient counseling. The bill would require the court to refer the matter to the licensing board for disciplinary action if it found unprofessional conduct on the part of the mediator or licensed mental health professional.

Child abuse reporting: mandated reporters: tax-exempt organizations
Summary (as Introduced 1/30/2012): This bill would include volunteers of public or private organizations, including nonprofit organizations, whose duties require direct contact with and supervision of children in the list of individuals who are mandated reporters. The bill would also require employers to provide training in child abuse and neglect identification and reporting to their employees and volunteers who are mandated reporters.
This bill would require, for taxable years beginning on and after the date the bill is operative, the Franchise Tax Board to revoke the exemption of an organization if a person who is a mandated reporter in the scope of his or her duties in the organization has been found guilty of a misdemeanor, as provided, with respect to failure to report an incident of known or reasonably suspected child sexual abuse, as defined, in the scope of his or her duties in the organization. This bill would require the board to reinstate the exemption if the organization provides notification that the guilty verdict of the person has been overturned.

Summary (as Amended 8/15/2011): This bill requires under January 1, 2018, a health care provider who performs a mammography, if a patient has a certain level of breast density, as specified, to include the following notice in the written report sent to the patient: "Because your mammogram demonstrates that you have dense breast tissue, which could hide small abnormalities, you might benefit from supplementary screening tests, depending on your individual risk factors. A report of your mammography results, which contains information about your breast density, has been sent to your physician's office and you should contact your physician if you have any questions or concerns about this report."

SB 299: Senator Noreen Evans (D-Santa Rosa)
Employment: pregnancy or childbirth leave
Summary (as Amended 8/15/2011): This bill prohibits employers from refusing to maintain and pay for insurance coverage, as specified, for the duration of maternity leave up to four months, as specified. This bill authorizes employers to recover insurance premiums from the employee if the employee fails to return from maternity leave provided that the employee's failure to return from maternity leave is not due to leave taken under the Moore-Brown-Roberti Family Rights Act (CFRA), for a health condition that entitles the employee leave, or for another circumstance beyond the control of the employee. This bill requires the collective bargaining agreements of state agencies govern maternity coverage specified in this bill.
